The removal of the boundaries between the members of European Union in the legal sense is among the objectives of the European Union. Ensuring the minimum parallelism in the legal framework between the member countries is aimed via the regulations announced by the Council of Europe. Certainly, the legal institutions of Union member countries are specific to each member country, and sometimes they are different from the legal institiutions existing in all other member countries. Despite the presence of these institutions, the aim of the Executive Law of Europe is to provide a common application. Our country is not a member of the European Union, but has gained the candidate status, and the negotiations are ongoing. In the case of Turkey's EU membership, the regulations announced by the Council of Europe will also be effective in Turkey. Our study embraces the regulations, which shape the Executive Law of Europe, and the applications in the comparative law and especially German law and emphasizes the rank of Turkey in the legal system of European Union in the case of its EU membership.

Avrupa Birliği'nin amaçları arasında, Birlik üyeleri arasında sınırların hukuki anlamda kalkması bulunmaktadır. Avrupa Konseyi'nin çıkardığı Tüzükler vasıtası ile ülkeler arasında hukuki alanda asgari paralelliğin sağlanması amaçlanmıştır. Elbette ki, Birlik üyesi ülkelerin kendilerine özgü ve bazen diğer tüm ülkelerden farklı hukuki kurumları mevcuttur. Avrupa İcra Hukuku'nun amacı, bu kurumların varlığına rağmen, ortak bir uygulamayı sağlamaktır. Ülkemiz, Avrupa Birliği'ne üye değildir; ancak aday ülke statüsündedir ve müzakereler devam etmektedir. Türkiye'nin Birliğe üye olması halinde, Avrupa Konseyi'nin çıkardığı Tüzükler ülkemiz için de geçerli olacaktır. Çalışmamızda, Avrupa İcra Hukuku'na yön veren Tüzüklere, mukayeseli hukukta ve özellikle Alman Hukuku'nda yer alan uygulamalara yer verilmiş; Türkiye'nin Avrupa Birliği'ne üye olması halinde Avrupa Birliği hukuk sistemi içerisindeki yeri belirtilmeye çalışılmıştır.
