İBN ÂBİDÎN'İN REDDÜ'L-MUHTÂR ADLI ESERİNDE AHKÂMIN DEĞİŞMESİ Eski klasik kaynaklarımızda yer almakla birlikte İslâm hukûkunda ahkâmın değişmesi konusunun bir problem olarak ele alınıp incelenmesi oldukça yenidir. XVIII. yüzyıldan itibaren Batı'da meydana gelen ve İslâm dünyasını da etkisi altına alan köklü değişikliklerin İslâm hukûkunda birçok problemin ortaya çıkmasına sebep olması ahkâmın değişmesi konusunu önemli bir problem haline getirmiş ve bu konu hem İslâm hukûkuyla ilgili çeşitli eserler içerisinde hem de müstakil olarak araştırılmıştır. Yakın dönemde yapılan bu araştırmalarda ahkâmın değişmesi konusu daha çok genel olarak ele alınmıştır. Bu çalışmada ise İbn Âbidîn'in Hâşiyetü Reddü'l-muhtâr isimli eserindeki örnekler çerçevesinde konu daha özel bir boyutta ele alınarak; İbn Âbidîn'in kendisinden önceki fakihlerden farklı hüküm verip vermediği ve hangi durumlarda farklı hüküm verdiği belirlenmeye çalışılmıştır. Örnekler dikkate alındığında İbn Âbidîn'in; örf-âdet, fesâdü'z-zemân (genel ahlakın bozulması), zarûret ve ihtiyaç gibi gerekçelerden hareketle zaman zaman kendisinden önceki fakihlerden farklı hükümler verdiği görülmektedir. EXTRACT CAHANGE OF JUDGEMENTS IN THE IBN ABIDIN'S WORK OF REDD AL MUHTAR In Islamic law, modification of judgements researching as a problem is rather recent despıte the fact that it is included in early classic origin. Hoppened since XVIII.th century and effecting the Islamic world the radical modifications wich cawrd very problems to rise in Islamic law let the alteration of judgements be a significant problem. This matter has been both included verious Islamic works and searched independantly. In the recent researches, the matter of modification of judgements has been dealt with as an in general rule. In this study, the matter whatter Ibn Abidin has sudged differrent from previous Islamic lawyers ar not and at which stuations was that different has been tried to achiere basing on examplems in his work of Hasiyet Redd Al Muhtar white specific diamension. When these examples take into consideration it is easy to see that Ibn Abidin basing on justification like; usage and custom disordered common ethic, exigence and requirement has sometimes judged different from former Islamic lawyers.
