Abstract

İslam ceza hukukunda ta'zir konusu, literatürde bazen ayrı bir kategoride işlenmekle birlikte, genel olarak bakıldığında dağınık olarak incelemiştir. Bu çalışmada, İslam hukuk literatüründe yer alan ta'zir cezası ile ilgili risaleleri ayrı bir literatür nevi olarak ele aldık. Ta'zir risaleleri konu ile ilgili yazılmış ve ayrı bir sistematik içinde ele alınmış eserlerdir. Tespit edilen risaleler; İbn Nuceym'in Risale fi ikameti'l-kadi et-tazira; Mahmud b. Pir Mehmed Fenari'nin Mesailü't-ta'zir ve hududu'l-cinayat; Hasan Kafi el-Akhisari'nin Makaletün fi't-ta'ziri'ş-şer'î; Kasım el-Müderris'in Risaletün fi't-taziri'ş-şer'î; adlı eserlerdir. Bu risaleler, Hanefi mezhebi esas alınarak yazılmışlardır ve ta'zir konusu ile ilgili farklı bir perspektifi yansıtmaktadır. Çalışmada ayrıca ta'zir risaleleri arasında temsil kabiliyeti yüksek olan, Muhyiddin Çivizade'nin Risale müteallika bi't-teazir adlı risalesini tahlil etmekteyiz. Bu çalışma, diğer ta'zir risaleleri arasında en kapsamlı ta'zir risalesidir. Gerek diğer ta'zir risaleleri, gerek ta'zir konusunun ele alındığı diğer eserler arasında sistematik özelliği orijinal olan bir risaledir. Yoğun olarak iktibasta bulunulan eserleri itibarıyla zamanının muteber edilen kaynakları hakkında da fikir vermektedir. Yazıldığı zamandaki kanunname çalışmalarını anlamada yardımcı olmaktadır. Sonuç olarak bu çalışma, İslam hukuk literatüründe ta'zir risaleleri olarak nitelendirilebilecek yeni bir türün varlığını ortaya koymaktadır. Bu açıdan yazıldıkları zamanın hukukî düşüncesinin anlaşılmasına katkıda bulunmaktadır.

I will argue in this study that there existed a genre of ta'zir booklets, which have not, up to now, yet been classified as an independent category within the literature. We see that the issue of ta'zir is treated in other works in an unsystematic way: it is located in a separate category but also scattered around within many other issues. The ta'zir booklets are generally based on the Hanefite school of law, being a product of its broad perspective regarding the issue of ta'zir. The ta'zir booklets analyzed here include Ibn Nuceym's Risale fi ikameti'l-kadi et-tazira; Mahmud b. Pir Mehmed Fenari's Mesailü't-ta'zir ve hududu'l-cinayat; Hasan Kafi el-Akhisari's Makaletün fi't-ta'ziri'ş-şer'î; Kasım el-Müderris's Risaletün fi't-taziri'ş-şer'î; I will, however, give special emphasis to Muhyiddin Çivizade's Risale müteallika bi't-teazir, and analyze it as an example, which has the ability to represent the genre of ta'zir booklets. This booklet has some special features. First, it is most comprehensive of all booklets; second, it is written in a systematic way unlike many others; and third, it was the main source of reference of its time and has several manuscripts. It also makes it possible to have a better understanding of the kanunnames at that time, since it is closely connected to them. Consequently, this research will reveal the existence of a new genre called ta'zir booklets in the literature of Islamic law, a research which will also contribute to the understanding of the legal thought of a particular time.
