Abstract

Il consenso quale elemento essenziale per assicurare il governo della persona sulle scelte esistenziali che attengono al proprio corpo di cui si deve poter “mantenere il controllo fino ai confini dell’esistenza”, è considerato un principio fondamentale nella bioetica. Lo stesso principio ha trovato da tempo riconoscimento anche in campo giuridico: a livello internazionale e sovranazionale, dove è stato ricollegato ai diritti dell’uomo da una serie di atti normativi ed a livello nazionale, dove è stato ricollegato ai diritti fondamentali riconosciuti nelle varie Costituzioni. Sono state infatti le decisioni delle diverse giurisprudenze delle Corti Supreme nazionali a consacrarlo, anche dove ne mancava un’espressa formulazione, a principio di rango costituzionale. Anche in Italia, ora, due pronunce della Corte costituzionale e della Corte di Cassazione, portando a termine un lungo cammino, ne hanno ribadito infatti il carattere di regola essenziale che trova le sue radici negli art. 2, 13 e 32 Cost. Il principio del consenso realizza così la sintesi fra due diritti fondamentali: il diritto alla salute e il diritto all’autodeterminazione di cui viene riconosciuta la natura di autonomo diritto fondamentale.
