Abstract

Objetivo: O objetivo desta pesquisa foi o de analisar se os atuais procedimentos adotados para efeito de rastreabilidade da madeira explorada em florestas nativas estão em consonância com os princípios fundamentais voltados à proteção do meio ambiente. Metodologia: A metodologia utilizada foi o método dedutivo, analisando-se as premissas gerais adotadas pelo Brasil em relação ao meio ambiente; quanto aos meios foi uma pesquisa bibliográfica e, quanto aos fins, qualitativa. Resultados: A conclusão a que se chegou foi a de que em face do princípio da precaução, da Política Nacional do Meio Ambiente e da constituição da República Federativa do Brasil de 1988, o poder público deve exigir a implantação de metodologia adequada para permitir a rastreabilidade eficiente da madeira extraída de florestas nativas. Contribuições: A contribuição que esta pesquisa oferece é a de que a partir do mecanismo sugerido na pesquisa é possível controlar a saída da madeira ilegal produzida na Amazônia, que gira em torno de 80%, ou mesmo evita-la; logo, a pesquisa oferece subsídios para o Estado para que, a partir desta, melhore a sua atuação na região estabelecendo mecanismos para manter-se a floresta em pé e gerando serviços ambientais

Objective: The objective of this research was to analyze whether the current procedures adopted for the purpose of traceability of wood harvested in native forests are in line with the fundamental principles aimed at protecting the environment. Methodology: The methodology used was the deductive method, analyzing the general premises adopted by Brazil in relation to the environment; as for the means, it was bibliographical research and, as for the ends, it was qualitative. Results: The conclusion reached was that in view of the precautionary principle, the National Environmental Policy and the constitution of the Federative Republic of Brazil in 1988, the government must demand the implementation of an adequate methodology to allow traceability efficient use of wood extracted from native forests. Contributions: The contribution that this research offers is that, using the mechanism suggested in the research, it is possible to control the output of illegal wood produced in the Amazon, which is around 80%, or even to avoid it; therefore, the research offers subsidies to the State so that, from there, it can improve its performance in the region, establishing mechanisms to keep the forest standing and generating environmental services.
