Abstract

A partir des années 70, les problèmes liés au langage juridique attirent l’attention des philosophes du droit et des linguistes, qui se penchent sur des analyses à caractère descriptif et se regroupent autour de leur objet d’étude : le langage du droit (ou juridique). Au cours des années 80 et 90 l’essor d’une nouvelle discipline lie la linguistique et les sciences juridiques : elle est baptisée au Canada avec le nom de Jurilinguistique et se caractérise par l’attention qu’elle réserve à la traduction juridique. En France, dans un contexte juridique qui s’éloigne du multilinguisme et du multijuridisme canadien et suisse, on privilégie la dénomination de Linguistique Juridique, qui explicite la convergence des études de type juridique et linguistique, désormais considérée comme incontournable. Nous nous proposons de brosser les généralités du parcours qui a mené de l’essor au développement récent de cette discipline aux dénominations différentes – sont-elles porteuses de véritables différences au niveau de méthodologie et d’approche ou ne s’agirait-il plutôt de variantes diatopiques désignant la même discipline ? – à travers les contributions des auteurs qui l’ont illustrée au Canada et dans les pays francophones d’Europe, notamment en France et en Suisse.
