En el marco del proceso de flexibilización laboral, aplicado en Argentina en los años 90, se creó el sistema de pasantías universitarias. Las pasantías eran presentadas como prácticas formativas que no implicaban una relación laboral entre el pasante y el empleador. Esta situación eximía a los pasantes de beneficios sociales y económicos propios de un trabajo, favoreciendo la utilización fraudulenta de la pasantía para cubrir puestos efectivos. Durante el gobierno de Cristina Fernández de Kirchner, en el año 2008, se sancionó una nueva ley que buscaba mejorar sus condiciones laborales. A pesar de ello, la pasantía sigue sin ser reconocida como un trabajo. El objetivo de este artículo será analizar las representaciones laborales de los pasantes en relación a su práctica, estableciendo un análisis comparativo con el discurso legal sostenido desde el marco regulatorio del sistema de pasantías universitarias.
In the context of the labor flexibility, applied in Argentina in the 90's, was created the system of university internships. The internships were presented as training practices that did not involve an employment relationship between the student and the employer. This situation exempted the interns of social and economic benefits own of a job, promoting the fraudulent use of the internship to cover actual places. During the government of Cristina Fernandez de Kirchner, in 2008, a new law was enacted that sought to improve their working conditions. However, the internship is still not recognized as work. The purpose of this paper is to analyze the labour representations of the interns about th eir practices, establishing a comparative analysis with the legal discourse of the regulatory for university internship system.
