Abstract

Los estudios que frecuentemente abordaron la temática de la justiciabilidad de derechos sociales desde el campo jurídico tendieron a soslayar el lugar de la política y de la economía de mercado. Los efectos de ese punto ciego han sido múltiples: entre ellos, una visión incompleta de los actores involucrados en las políticas sociales y de los conflictos que los atraviesan; y el dominio de una visión procesal y formalista de los derechos, que resulta familiar para los juristas pero que suele dejar de lado otros asuntos relevantes (en especial, los problemas de la provisión de bienes y servicios sociales). En ese sentido, este artículo tiene el propósito de abordar la forma compleja y cambiante de la relación entre las aspiraciones igualitarias de los derechos sociales y la intervención del poder judicial por un lado y los mecanismos de producción y reproducciones de las desigualdades sociales en sociedades de mercado por el otro. Para ello recuperamos tres perspectivas teóricas: i) los aportes provenientes de los estudios críticos del derecho que iluminan sobre el carácter ambiguo de los derechos como expresiones de luchas de poder y estructuradores de desigualdades a la vez que destacan su potencia transformadora; ii) los estudios que a través del abordaje de las formas históricas de expansión de la ciudadanía social como ideal de igualdad, comprendieron los arreglos institucionales productores de nuevas formas de desigualdad en las sociedades capitalistas; iii) los enfoques sobre la economía política del bienestar que introdujeron los conceptos de mercantilización y desmercantilización como dimensiones centrales de análisis para comprender los procesos políticos institucionales que dieron forma a la provisión de satisfactores de necesidades sociales, mediados conflictivamente por la lógica de los derechos.

Studies frequently addressed the issue of justiciability of social rights from the legal field tended to overlook the place of politics and market economy. The effects of this blind spot have been many: among them, an incomplete view of the actors involved in social policies and conflicts that cross; and mastery of a procedural and formalistic view of rights, which is familiar to lawyers but often ignored other relevant issues (in particular, the problems of provision of social goods and services). In that sense, this article aims to address the complex and changing shape of the relationship between the egalitarian aspirations of social rights and the intervention of the judiciary on the one hand and the mechanisms of production and reproduction of social inequalities in societies market on the other. To do, we recover three theoretical perspectives: i ) contributions from the critical legal studies that illuminate on the ambiguous nature of the rights as expressions of power struggles and structuring of inequalities while highlighting its transforming power ; ii) studies through the approach of the historical forms of expansion of social citizenship as an ideal of equality, understood the producers of new forms of inequality in capitalist societies institutional arrangements; iii) approaches on the political economy of welfare that introduced the concepts of marketization and commodification as central dimensions of analysis to understand the institutional political processes that shaped the provision of satisfaction of social needs, mid conflictively by the logic of rights.
