Tierras conquistadas, tierras apropiadas

Abstract

Los territorios indígenas conquistados por las armas fueron incorporados como parte del patrimonio público al Estado, que acumuló derechos de títulos sobre tierras ahora fiscales, para transferirlas a propietarios particulares -individuales o colectivos-, que accedieron a las mismas casi siempre en grandes superficies, y muchas veces en carácter de donación o a precios extremadamente bajos. La acción jurídica se completaría con la organización administrativa y el gobierno de los nuevos Territorios Nacionales, creados por ley 1532 de 1884. Pero buena parte de estos nuevos propietarios no ocuparían ni explotarían sus campos, al menos de inmediato, sino que esperarían a obtener mayores ganancias a través del incremento de la renta o la venta de sus propiedades en el período posterior a la organización de los mismos. De la legislación aplicada, las formas de acceso y su ocupación efectiva nos ocupamos en este capítulo.
