Los derechos de los comuneros: Comunidad, tierras y jurisdicción en la provincia de Córdoba en el siglo XIX

Abstract

La historia de la persistencia de los pueblos de indios en la provincia de Córdoba en el siglo XIX se enlaza con la de sus dos expropiaciones públicas: de las tierras comunales y de la jurisdicción civil y criminal de los cabildos de indios, que antecedió el desconocimiento de los curacas o caciques. Mediante una síntesis de investigaciones disponibles y la integración de nuevas fuentes, procuraremos poner de manifiesto que ambas expropiaciones se dieron de manera desfasada y con ritmos diferentes. De manera más lenta pero temprana, el desconocimiento de las autoridades, en particular de los caciques. De manera más abrupta, homogénea y tardía -para las seis comunidades persistentes hasta 1880- la expropiación de las tierras. Posiblemente ambas expropiaciones no hayan significado la desarticulación de todas las comunidades -más bien su invisibilización como colectivos, mantuvieran o no tierras en común-, pero recortaron significativamente derechos adquiridos en el período colonial que habían sido hasta entonces celosamente defendidos por sus miembros o buena parte de ellos, incluso dentro de dinámicas de profunda transformación interna.
