Escribanos y escrituras en Hispanoamérica

Abstract

El presente capítulo demuestra que el escribano ejercía una función ambivalente en la Hispanoamérica de Antiguo Régimen. Era un mediador activo que detentaba, por un lado, la potestad legítima de ofrecer los dispositivos contractuales necesarios para agilizar el carácter jurídicamente ejecutable de los tratos y, por el otro, una posición informacional privilegiada que le confería un rol condicionante en la interacción económica. Sólo su persona podía satisfacer la demanda de resguardos jurídicamente ejecutables; sólo su archivo podía satisfacer la demanda de información requerida por los actores sociales en la economía comercial. De esa manera, su presencia no sólo habilitaba la concreción de numerosas transacciones, sino que adecuaba la heterogénea singularidad de situaciones sociales a un número definido de formatos prescriptos, que dotaban de legitimidad a los tratos al inscribirlos en un ordenamiento legal.
