El presente trabajo busca reflexionar sobre las medidas especificas tomadas por el Estado Argentino para atender a las necesidades de las personas con discapacidad, respecto de su derecho a libertad de transito, en el contexto del aislamiento social preventivo y obligatorio a causa de la pandemia por COVID-19. Se abordó metodológicamente mediante el análisis de instrumentos normativos nacionales, provinciales y municipales que reglamentaron excepciones especiales de transito parapersonas con discapacidad, posicionados desde una perspectiva de Derechos Humanos.Tras su análisis, los instrumentos demostraron no contemplar de manera integral los derechos y necesidades de las personas con discapacidad, por lo que consideramos necesario introducir modificaciones, en particular aquellas que respeten los derechos a una vida autónoma y libertad ambulatoria
This work tries to ponder around the specific policies taken by the argentinian goverment to attend the needs of People living with disability, specifically on their right to personal freedom, during the social distancing measures due to COVID-19.Methodologically, we analized national, provincial and municipal normative, that gave exception to abide to social distancing orders to people living with disabilities, we made this from a human rights perspective. After its analysis, the normative instruments don’t seems to fully contemplate the rights and needs of people living with disabilities, we consider it is necesary to introduce amendments that respects the rights of an autonomous life and personal freedom
