Este trabajo se estudia la naturaleza jurídica y moral de la omisión o suspensión de cuidados vitales, a partir de una aproximación realista a la teoría de la acción. Se toman como referencia las obras de John Finnis, Martin Rhonheimer, Kevin Keiser y Elisabeth Anscombe y se aplica la teoría de la acción recogida en esta línea de pensamiento, al problema concreto de la omisión de cuidados vitales, utilizando las teorías de la omisión de J. Rachels (en «Euthanasia, Killing, and Letting Die», en Ladd, J. (ed) Ethical Issues Relating to Life and Death, Oxford University Press, New York-Oxford, 1979, 146-163); H. Mc. Lahalan («The Ethics of Killing and Letting Die: Active and Passive Euthanasia». Journal of Medical Ethics 34, (2008), 636-638, 637); y A. Mc. Gee («Ending the Life of the Act/Omission Dispute: Causation in Withholding and Withdrawing Life-sustaining Measures». Legal Studies 31, (2011), 467-491, 476.).Se describen en detalle los criterios de tipificación e individuación de la acción desde una perspectiva moral y desde una perspectiva jurídica. Se arguye que, si bien los desafíos cognitivos del juicio judicial de individuación de la acción son más profundos que los desafíos cognitivos del juicio moral de individuación de la acción; estos desafíos no impiden su objetividad.
This work aims at two objectives. Firstly, at identifying the basic criterions that underlie the conceptual distinction between letting die, on the one hand, and killing by omitting or withdrawing vital care (VCO), on the other. Secondly, at identifying the reasonableness conditions of public interference on the decision either to reject or to withdraw vital care. Based upon a theory of action inspired in the works of John Finnis, Martin Rhonheimer and Elisabeth Anscombe, it is argued that the moral criteria of typification and individuation of VCO is analogous but not identical to the corresponding legal criteria. Assuming this distinction, I suggest a three steps reasonableness test for public interference on the decision to omit or withdraw vital care.
