The aim of the punishment according to Kant is a recurrent topic in the Philosophy of Crime and Punishment. There are different interpretations on this matter. The authors take for their reasoning the passages of “The Metaphysic of Moral”. We choose, instead, in this research to analyse it from another kind of source,namely “The lectures on ethics”. The lectures help to reveal how Kant generated his point of view that was embodied in their practical philosophy works; they are also useful to clarify their contradictions. With this aim in mind, we select the nonduplicate group of notes as the sources of information; these notes cover the period (approximately) between the years 1766-1794. During that period, we visualize, in the first instance, Kant as a defender of the deterrence and, in a second instance, Kant accentuates the absolute criteria. The conclusions we arrive are, however, partial, due to the nature of the selected sources.

La finalidad de la pena según Kant es un tema recurrente en la disciplina penal. Existen variadas interpretaciones al respecto. Los autores toman para fundamentaciones los pasajes de La metafísica de las costumbres. Nosotros, por el contrario, en la presente investigación optamos por analizarla a partir de otro tipo de fuente, a saber: ?Las lecciones sobre filosofía moral?. Las lecciones ayudan a develar cómo Kant engendró su postura que fue plasmada en sus diversas obras sobre filosofía práctica, como así también a aclarar sus contradicciones. A tal fin, seleccionamos los manuscritos no duplicados como fuentes de información; estas notas cubren el periodo aproximando entre los años 1766-1794. Las conclusiones a las que arribemos son parciales, dada la naturaleza de las fuentes seleccionada.
