Abstract

Temaet for oppgaven er grunnervervsforhandlinger gjennomført av Statens vegvesen region øst. Oppgaven tar sikte på å belyse hvordan forhandlingene om erstatningen forløp, sett fra grunneiers perspektiv. Herunder ønsker jeg å se nærmere på hvorfor erstatningen økte for grunneiere som takket nei til det første tilbudet. Oppgaven bygger på en tidligere bacheloroppgave fra Høgskolen i Bergen «Forhandlinger ved grunnerverv» av Christiansen og Svendsen (2016), og en masteroppgave fra Norges- miljø og biovitenskapelige universitet «Minnelig avtale ved grunnerverv» av Unneberg og Korsbøen (2017). Hovedproblemstillingen for masteroppgaven er følgende: hvordan forløp forhandlingene om erstatning ved inngåelse av minnelig avtale? Materialet som presenteres i oppgaven er basert på intervjuer med 15 grunneiere bosatt på Østlandet. Samtlige grunneiere har inngått minnelig avtale med Statens vegvesen i perioden 2012-2016. Noen grunneiere avsto deler av eiendommen, andre har innløst bolig- eller fritidseiendom. Grunnervervsforhandlinger er en spesiell forhandlingssituasjon, blant annet fordi grunneier blir tvunget inn i forhandlinger med en profesjonell aktør, og hvor alternativet til minnelig avtale er rettslig skjønn. Videre legger rettslige rammevilkår føringer for forhandlingene da erstatningen skal fastsettes på bakgrunn av gjeldene lovverk og rettspraksis. Det var flere faktorer som påvirket forhandlingene om erstatningen. Blant annet var bruk av juridisk bistand, omfanget av inngrepet og grunneiers innstilling til vegprosjektet av betydning for forhandlingene. Grunneierne har hatt ulike opplevelser av forhandlingsprosessen, de som takket nei til det første tilbudet har hatt en mer omfattende forhandlingsprosess enn dem som takket ja til det første tilbudet. Riktig erstatning og tiltak er avgjørende faktorer for inngåelse av minnelig avtale. Samtlige som takket nei til det første tilbudet har fått økt erstatning. Funnene indikerer at ny informasjon, juridisk bistand, tidspress og alternativene til minnelig avtale er med på å presse erstatningen opp. Videre går det frem av oppgaven at entydig informasjon og god kommunikasjon mellom grunneier og grunnerververen er vesentlig for å tilrettelegg for et godt forhandlingsklima.

The theme of this master’s thesis is land acquisition negotiations done by the Norwegian Public Roads Administration region east. The purpose of the thesis is to illuminate how the negotiation process on compensation proceeded, seen from the landowner’s point of view. The thesis is inspired by a bachelor thesis from Bergen University College “Negotiations on land acquisition” written by Christiansen and Svendsen in 2016, and by a master’s thesis from Norwegian University of Life Sciences “Amicable agreements during land acquisition” written by Unneberg and Korsbøen (2017). The thesis research question is: how did negotiations on compensation proceed during the amicable agreement? The presented material is based on interviews with 15 landowners. All landowners have entered amicable agreement with the Norwegian Public Roads Administration (NPRA) in the period of 2012-2016. Some landowners refrained parts of their land, others redeemed their residential. Land acquisition negotiations differ from ordinary negotiations as the landowner is forced into a negotiation with a professional party, and where the alternative to an amicable agreement is legal discretion. How the negotiation on compensation proceeded depended on different factors, like whether or not the landowner accepted the first compensation offer, legal aid, and how much land the landowner had to refrain. The landowner’s expectations and approach to the road project and negotiations have also been significant for the negotiation process. Right compensation and measures on the property is crucial for the amicable agreement. The findings indicate that new information, legal aid, time pressure, and the alternatives to an amicable agreement are elements that increases the compensation. Furthermore, the thesis shows that unambiguously information and good communication between landowner and NPRA is important to maintain a suitable negotiation climate.
