Abstract

La publicación del tomo II de la Historia de los Derechos fundamentales dirigida por Gregorio Peces Barba, Eusebio Fernández García y Rafael de Asís Roig, constituye un acontecimiento editorial importante. La obra en tres volúmenes, aporta abundante información sobre el siglo XVIII : contexto general, planteamientos filosóficos y positivización de los derechos. Sin negar el enorme valor de esta obra, es posible realizar algunas observaciones críticas sobre supuestos que en ella se exponen : la interpretación del pasado desde la actualidad, la preferencia por el concepto de derechos fundamentales frente al de derechos humanos y la interpretación dada a la intolerancia religiosa.
