Direito à morte digna

Abstract

Este trabalho vai de desenvolver um tema bastante complexo, acerca da ortotanásia, mas pelo viés do testamento vital. É impossível discutir esse assunto sem pensar na bioética, que se refere ao posicionamento ético dos sujeitos,para que tais atitudes não ocasionem tragédias na sociedade. Na verdade, é como se fosse uma trava, por isso a sua importância aqui: estamos tratando de vida e morte. A medicina não pode, de forma alguma ser desumana, o paciente precisa estar sempre em primeiro lugar e nesse sentido se discutirá a dignidade da pessoa humana, que confere a um paciente terminal, o direito, ao menos, de ter uma morte digna. A ortotanásia oferece ao paciente a possibilidade de morrer no tempo certo sem sofrer tratamentos degradantes, que não o levarão a nada. Dessa maneira, o cerne do trabalho é justamente a constitucionalidade da ortotanásia, à luz do viés do testamento vital.
