Abstract

In the universe of means of obtaining evidence, the topic we are willing to address is the one related to the use of subjects as a means of obtaining evidence, in this case the undercover agent, to study the barriers between this and the provocateur. To what extent is the use of this means admissible, taking in to account the rights that they conflict with, especially those arising form the principle of human dignity, provided for the Portuguese legal system by article 1 of the CRP and linked the protection of the core of fundamental rights, namely moral freedom in the formation and decision of the will, with Constitutional provision under the terms of article 32.º no. 8, of the CRP, in the European legal order in article 8 CEDH, in article 3, no. 1, of the CDFUE. In the Angolan legal system, there is a Constitutional omission in the provisions of article 67 of the CRA, in opposition to Law 10/20, of 16.04 in the provisions of paragraph 1 of article 57, also of the CRA, in conjunction with article 4 of the CADHP. We will also analyze the case of excess, that is, if the agent goes from undercover to provoker, because they are professionals who do not detach themselves from the human condition, although directed by criminal responsibility. Will also focus on the analysis of legal regimes of both States, consulting the doctrine and jurisprudence of the Courts of Appeals, Supreme, Constitutional of Portugal and Angola, not forgetting that of the TEDH, in order to exhaust the available resources to better understand the need of the use of this means of obtaining evidence and verifying whether it is proportionate in view of less harmfulness of the rights, freedoms and guarantees, corollaries of human dignity. The central theme will also focus on the analysis of the legal regimes of both States, consulting the doctrine and jurisprudence of the Courts of Appeal, Supreme, Constitutional of Portugal and Angola, not forgetting that of the TEDH, in order to exhaust the available resources for better perceive the need to use this means of obtaining evidence and verify if it is proportional in the face of less harmfulness of the rights, freedoms and guarantees, corollaries of human dignity.

No universo dos meios de obtenção de prova, o tema a que nos predispomos abordar é o relativo ao uso de sujeitos como meio de obtenção de prova, no caso o agente encoberto, estudar as barreiras entre este e o agente provocador. Até que ponto é admissível o uso deste meio, tendo em conta os direitos que com os quais colidem, mormente os que decorrem do princípio da dignidade da pessoa humana, previsto no ordenamento jurídico português pelo art.º 1.º, da CRP e ligado à proteção do núcleo dos direitos fundamentais, nomeadamente a liberdade moral na formação e decisão da vontade, com previsão Constitucional nos termos do art.º 32.º n.º 8, da CRP, na ordem jurídica europeia no art.º 8.º CEDH, no art.º 3.º n.º 1, da CDFUE. Já no ordenamento jurídico angolano verifica-se uma omissão constitucional cfr. artigo 67.º, da CRA1. Analisaremos também o caso de excesso, isto é, caso o agente passe de infiltrado a provocador, por se tratarem de profissionais que não se desligam da condição humana, embora dirigidos por autoridade de polícia criminal ou autoridade judicial, haverá responsabilidade criminal. O tema central incidirá igualmente sobre a análise dos regimes jurídicos de ambos os Estados consultando a doutrina e a jurisprudência dos Tribunais da Relação, Supremo, Constitucional de Portugal e Angola, não esquecendo a do TEDH, de forma a esgotar assim os recursos disponíveis para melhor perceber a necessidade do uso deste meio de obtenção de prova e verificar se o mesmo é proporcional face a menor lesividade dos direitos liberdades e garantias, corolários da dignidade humana.
