Inimputabilidad de las personas con discapacidad

Abstract

Las personas con discapacidad conforman un colectivo heterogéneo, ya que la discapacidad se manifiesta en distintos grados, necesidades de asistencia o protección. El Código Penal incorporó la “discapacidad” en la reforma que se lleva a cabo en el año 2015. En su redacción original de 1995, apenas se hacía referencia a las personas con discapacidad, más allá de tipificar la falta de asistencia o auxilio a estas personas. A esta reforma hay que sumar la Ley 8/2021. Estas reformas responden a la necesidad de adaptar la legislación en España la Convención internacional sobre los derechos de las personas con discapacidad. El trabajo se centrará en esta Convención, el impacto de la misma en el ordenamiento jurídico español, especialmente en materia penal, y la inimputabilidad de las personas con discapacidad.

People with disabilities with disabilities make up a heterogeneous group, since disability manifests itself to different degrees, needs assistance or protection. The Penal Code incorporated "disability" in the reform that was carried out in 2015. In its original draft of 1995, there was hardly any reference to people with disabilities, beyond typifying the lack of assistance or help to these persons. To this reform we must add Law 8/2021. These reforms respond to the need to adapt the legislation in Spain to the “International Convention on the Rights of Persons with Disabilities”, made in “New York on December 13, 2006”. The work will focus on this Convention, its impact on the Spanish legal system, especially in criminal matters, and the immunity of persons with disabilities.
