El sistema penal en Hegel.

Abstract

La producción sistematizada del derecho penal proviene de las obras de Kant y de Hegel. Con fundamento en sus textos La Metafísica de las Costumbres y los Principios de la Filosofía del Derecho, surgieron las dos tendencias fundamentales que informan el derecho penal subjetivo y el derecho penal objetivo, con sus correlatos manifiestos en las distintas escuelas del derecho penal, visibles a partir del Siglo XIX. La parte correspondiente a Kant se desarrolló en artículo anterior y ahora se desarrolla la filosofía hegeliana.

The systematic production of criminal law comes from the works of Kant and Hegel. Based on his writings Metaphysics of Morals and Principles of the Philosophy of Right, there were two main trends that subjective report the criminal law and criminal law objective, with obvious correlations in the various schools of criminal law, visible from nineteenth century. The share of Kant was developed in the article of the previous delivery, and now develops Hegel’s philosophy.
