Resumen: La finalidad de este trabajo es determinar el contenido de los conceptos de “fletador” y “cargador” que la nueva Ley 14/2014, del 24 de julio, de Navegación Marítima utiliza, términos que la propia Ley no define. Para ello, es necesario tener muy presente el nuevo concepto de “súper-contrato” de fletamento de dicha Ley. Con ello, y a partir del sentido con que históricamente han venido siendo empleados los términos “fletador” y “cargador” en nuestro derecho, las interpretaciones de expertos en la materia, el análisis de la utilización de los términos a nivel internacional y en otras legislaciones, y con un método analítico y empleando técnicas para la interpretación de las reglas jurídicas se pretende determinar las definiciones de “fletador” y “cargador” que el legislador maneja, así como si la nueva Ley utiliza los términos en un único sentido o si por el contrario, aplica varias acepciones a los mismos. Al mismo tiempo se pretende ver si en este aspecto la Ley puede considerarse que favorece la seguridad jurídica, si es acorde con la realidad del sector y con los nuevos Convenios Internacionales sobre transporte de mercancías por mar, como las Reglas de Rotterdam, a los que es deseable que la normativa de los países se adapte, en aras de la uniformidad jurídica. Sin embargo como podremos concluir, parece que en el caso de la nueva normativa española representada por la Ley de Navegación Marítima, la precisión de los conceptos estudiados y esa labor de acercamiento no se ha logrado del todo en esta concreta materia.

Abstract: The aim of this paper is to determine the content of “charterer” and “shipper” notions that the 2014 Spanish Maritime Navigational Law uses but does not define. To that end, it is necessary to consider the new concept of “freightment contracting” incorporated within that law. Here we take into consideration the historical use of terms such as “charterer” and “shipper” in the Spanish Law as well as the interpretations of experts in this field. Additionally, we analyze both international and national legal uses of these terms by employing an analytical method and using legal interpretation techniques. The ultimate goal is to establish definitions for “charterer” and “shipper” by determining whether the new law uses such terms in a singular manner or, contrastingly, whether various meanings are attributed to the terms. At the same time, we seek to see whether, in this regard, the law can be considered as favoring legal security and whether it is in accordance with realities within the sector as well as with the new international conventions that regulate the transport of goods by sea, such as the Rotterdam Rules, whose goals are for national norms to align with these conventions. However, as we will conclude, it seems that in the new Spanish norms, represented by the Spanish Maritime Navigational Law, there is still a lack of precise understanding of these terms and the goal of shared understanding in accordance with international regulations has still not been met.
