ABSTRACT: The inability to have children it affects a large percentage of the population. So, a number of different assisted -.reproduction techniques have been created in order to solve this situation. The choice of surrogacy motherhood as an option for dealing with sterility and for those who want to have the possibility of parental rights has increased throughout the years. Fertilization is a free and natural aspect of human life. This procedure is creating great controversy as being a product subject to law or trade. Analyzing the surrogate motherhood in relation with bioethics it’s possible to prove the difficulty of finding a consensus, since we can find arguments that retract or support this practice. The arguments that defend the freedom and rights to the paternity of the contracting parents and the freedom of decision of the surrogate mothers strike arguments describing the procedure as unnatural and commercial practice.
