Abstract

RESUMEN: El presente estudio de los debates parlamentarios de las Cortes de Cádiz sobre la abolición de la esclavitud en el primer liberalismo español va a ser presentado como Trabajo de Final de Grado. El mismo hace referencia a las distintas etapas por las que la figura de la esclavitud pasó en el ordenamiento jurídico español a lo largo de varios siglos, así como en las regulaciones de ciertos otros países. Inicialmente, se introduce una explicación de las primeras nociones que se tienen en la Historia acerca de la esclavitud, tanto en el mundo antiguo como en el medieval, así como el tratamiento que recibió durante dichas épocas. Más adelante, se desarrolla su evolución a lo largo del siglo XVIII en el seno de potencias europeas como Gran Bretaña, Francia y España. En lo que respecta a su desarrollo en el siglo XIX, el trabajo se centra en los casos de Gran Bretaña y Francia, mencionando los hitos más importantes a este respecto. A continuación, se explica el contexto que rodeó a las Cortes de Cádiz, antes, durante y después de su formación, así como algunas de las reformas jurídicas más sonadas que llevaron a cabo. Finalmente, se abre el análisis de los debates parlamentarios en las Cortes acerca de la abolición de la esclavitud. Primero, se hace una sucinta referencia a Isidoro de Antillón como inspirador del abolicionismo en España, para después señalar los días en que se llevaron a cabo las sesiones más importantes en lo que respecta a la abolición, procediendo así al estudio directo de las declaraciones vertidas por los diputados. También se muestra la interesante relación que existió entre la regulación jurídica de los derechos de los esclavos y de las mujeres en el régimen de la Constitución de 1812. Los últimos epígrafes del presente trabajo están dirigidos a explicar las vicisitudes de la abolición de la esclavitud en España con posterioridad a la labor de las Cortes, pasando por acontecimientos como la Restauración Absolutista, el Trienio Liberal y, por fin, la definitiva abolición y las etapas por la que tuvo que pasar en los diferentes territorios españoles.

ABSTRACT:The present study of the parliamentary debates of the Cortes of Cádiz on the abolition of slavery in the first Spanish liberalism will be presented as Final Degree Project. It makes a reference to the different stages through which the figure of slavery went in the Spanish legal system over several centuries, as well as in the regulations of certain other countries. Initially, it introduces an explanation of the first notions in history about slavery, both in the ancient and medieval world, as well as the treatment it received during those times. Later, it develops its evolution throughout the eighteenth century in the heart of European powers such as Britain, France and Spain. In terms of its development in the nineteenth century, the project focuses on the cases of Great Britain and France, mentioning the most important milestones in this regard. It then explains the context that surrounded the Cortes of Cádiz, before, during and after their formation, as well as some of the most prominent legal reforms they carried out. Finally, it opens the way for the analysis of the parliamentary debates in the Cortes on the abolition of slavery. First, a brief reference is made to Isidoro de Antillón as the inspirer of abolitionism in Spain, and then to the days when the most important sessions were held with regard to abolition, thus proceeding to the direct study of the declarations made by the members. It also shows the interesting relationship that existed between the legal regulation of the rights of slaves and women in the regime of the Constitution of 1812. The last epigraphs of this work are aimed at explaining the vicissitudes of the abolition of slavery in Spain after the work of the Cortes, passing through events such as the Absolutist Restoration, the Liberal Triennium and, finally, the definitive abolition and the stages through which it had to go in the different Spanish territories.
