Abstract

Is the article, the situation of the blck communities in Colombia is presented. The main part of the article shows that in spite of having a normative frame supposed to guarantee their cultural, territorial and environmental rights, they continue presenting difficult living conditions characterized by the poverty which is difficult to understand because they live in the tones with major quantiry of natural resources in the country; This situation can be explained for the low levels of health and education and as consequence of the violence in their territories. This document tries to show how in Chis last fifteen years -after the expedition of the Law 70 of 1993-, where different mechanisms are established in order to protect the cultural Identity and other rights of the black communities of Colombia they continue being victims of exclusion and marginalization.

En este artículo se presenta la situación de las comunidades negras o afrocolombianas, que no obstante contar con un marco normativo mediante el cual se garantizan sus derechos culturales, territoriales y ambientales, continúan presentando unas condiciones de vida caracterizadas por la pobreza a pesar de habitar en las zonas con mayor cantidad de recursos naturales en el país, por los bajos niveles de salud y de educación y, por las afectaciones generadas como consecuencia de la violencia que se presenta en sus territorios. Se pretende mostrar en este documento cómo quince años después de la expedición de la Ley 70 de 1993, mediante la cual se establecen mecanismos para la protección de la identidad cultural y los demás derechos de las comunidades negras de Colombia, su situación sigue siendo de exclusión y marginación.
