La presente tesis doctoral se orienta al estudio de la legitimación activa en las acciones colectivas como institución procesal para la tutela de los intereses colectivos jurídicamente protegidos. Empezando con la naturaleza, clases, características y modalidades de tutela de los intereses colectivos, este trabajo de investigación se centra en el análisis de los entes y sujetos legitimados para el ejercicio de las acciones colectivas en el ordenamiento jurídico español, junto con un estudio comparado de los sistemas existentes en Italia, Estados Unidos y Brasil, con la finalidad de establecer un modelo de legitimación para el adecuado y eficaz ejercicio de las acciones colectivas en España. En este sentido, se tratan cuestiones directamente relacionadas con la legitimación, tales como la financiación, la certification o los diferentes sistemas de acciones colectivas, son olvidar la ineludible perspectiva económica.
This doctoral thesis is orientated towards the study of standing in collective actions, which are a procedural remedy for the damages caused to legally-protected and collective interests. Beginning with the nature, types, characteristics and methods of redress for interests of this kind, the present research work focuses on the analysis of the subjects entitled to bring a collective action in the Spanish legal framework, together with a comparative study of the Italian, American and Brazilian systems, so as to establish a model of standing to bring a collective action in Spain, both adequate and efficiently. In that sense, directly linked aspects such as funding, the certification or the different systems of collective actions are treated, without neglecting the unavoidable economic perspective.
