Abordaje del conflicto penal juvenil a la luz de la Justicia Penal Juvenil Costarricense

Abstract

El presente trabajo aborda el tema del conflicto penal juvenil y su regulación dentro del sistema penal costarricense. El texto cuenta con un estudio histórico del desarrollo de la delincuencia en menores de edad tanto a nivel internacional como nacional. Se centra en un análisis sobre la justicia restaurativa y la implementación que esta tiene en Costa Rica, especialmente en la imposición de sanciones no privativas de libertad, sus beneficios y resultados para los y las delincuentes menores de edad en cuanto a la permisión del desarrollo de su personalidad. El análisis propuesto brinda la posibilidad de reflexión acerca de las medidas sancionatorias aplicadas a los y las delincuentes juveniles y la importancia de su carácter restaurador.

This article addresses the topic of juvenile criminal conflict and its regulation in Costa Rica ́s penitentiary system. The text counts with a historical study of the development of underage delinquency both internationally and nationally. It is centered on an analysis of restorative justice and its implementation in Costa Rica, especially on the imposition of sanctions that do not deprive of freedom, its benefits and result in the for underage criminals in reference to the development of personality that they allow. The proposed analysis provides the possibility to reflect on the punitive measures applied on juvenile offenders and the importance of its restorative characteristic.
