La concepción del Derecho Financiero y Tributario: relevancia de los aspectos metodológicos

Abstract

La cuestión sobre la metodología jurídica en el campo del Derecho Financiero y Tributario es un un tema que no debe considerarse cerrado, sino que está en constante evolución. Este trabajo realiza una síntesis de los presupuestos metodológicos que deben inspirar, con carácter general, cualquier elaboración científica del Derecho Financiero y Tributario. Partiendo de la Constitución Española y su proyección sobre el Derecho Financiero y Tributario, la Carta de los Derechos Fundamentales de la Unión Europea, el Convenio Europeo para la protección de los Derechos Humanos y de las Libertades Fundamentales y teniendo en cuenta el fundamento último del Derecho Financiero y Tributario –principio de solidaridad y redistribución de la renta–, el trabajo propone el pluralismo metodológico como exigencia de una concepción axiológico-valorativa del deber constitucional de contribuir al sostenimiento de los gastos públicos.
