Abstract

La historia de la Corte penal internacional empieza en 1994 con la adopción por la Comisión del derecho internacional de un proyecto de estatuto de una corte penal internacional permanente. Después de casi 4 años de negociaciones difíciles en la sede de las Naciones Unidas y 5 semanas de conferencia en Roma, fue adoptado el Estatuto de Roma de la Corte penal internacional el 17 de Julio de 1998. Las negociaciones siguieron con la adopción de textos segundarios pero muy importantes en el derecho aplicable ante la Corte, de conformidad con el artículo 21 de la Corte, como los Elementos de los crímenes y las Reglas de procedimiento y de prueba. El estatuto de Roma entro en vigor el primero de Julio de 2002, después de haber obtenido 60 ratificaciones. Cuenta ahora con 122 Estados Partes y un presupuesto anual de más de 100 millones de euros. Aunque el éxito del Estatuto de Roma es innegable, faltan todavía las ratificaciones de Estados muy importantes como China, Rusia, Estados Unidos, India y Pakistán.
