[EN] Medical assistance, and in particular vaccinations, has been drafted to preserve life since time memorial. Ethical and moral questions have arisen with the improvements of the utilized techniques and the evolution of science within the course of the years, that present legal issues that will be subjected to various studies to determine the current relationship the lies between fundamental rights, such as the physical and moral integrity stipulated in the art 15 of the Spanish Constitution , and the impact that can present these on the ideological freedom of each individual as an statutory right, as it is presented in the art. 1.1 of our Constitution, and mentioned in several international legal documents, of which our country is part of, or the art. 10 of the Chapter of Fundamental Rights of the European Union. Spain is constituted in a social and democratic rule of law, and therefore, the general medical treatment and vaccination are subject to the patient willingness. However, this is not an obstacle for the sanitary or legal institutions to impose a possible mandatory compliance, depending on specific cases or interests involved. Medical assistance currently entails the processing of data which, as an individual, affects the very personal rights of a patient. The treatment if this data must be subjected to a study to determined whether it is compliant with the Law, capture it on a certificate and determine if this circumstance violates any precepts or if, on other hand, it is authorized because collective safety and public health.

[ES] La asistencia médica, en general, y la vacunación, en particular, se han configurado desde tiempos inmemoriales como una forma de preservar la vida. Con el devenir de los años, la mejora de las técnicas a emplear y la ciencia en su evolución, da lugar a cuestiones éticas y morales que presentan temas jurídicos que se tienen que someter a estudio para determinar la relación existente entre derechos fundamentales, como la integridad física y moral del art. 15 de la Constitución Española, y la incidencia que puede presentar sobre los mismos la libertad ideológica del individuo también como derecho, por estar recogido en el art. 1.1 de nuestra Carta Magna, como en numerosos textos internacionales de los que nuestro país forma parte o el propio art.10 de la Carta de los Derechos Fundamentales de la Unión Europea. En un Estado social y democrático de Derecho como es España, el tratamiento médico con carácter general y la vacunación están sometidos a la voluntariedad del paciente, sin ser óbice a una posible obligatoriedad por parte de la autoridad sanitaria o judicial, según el caso concreto y los intereses en juego. La asistencia facultativa conlleva en la actualidad el procesamiento de datos que, como persona, afecta a derechos personalísimos del paciente. El tratamiento de estos datos ha de someterse a estudio para determinar si es ajustado a derecho su mecanización, plasmar los mismos en un certificado y si esta circunstancia vulnera algún precepto o está autorizado por favorecer la seguridad colectiva y la salud pública.
