Abstract

Toda obra es susceptible de protección por el mero hecho de su creación. La legislación de Propiedad Intelectual viene a tutelar las creaciones del ser humano, dando cobertura a las obras literarias, artísticas o científicas que emanan de la mente. De esta normativa, nuestro legislador, en un intento de abarcar todas estas creaciones, se ha manifestado la especial dificultad a la hora de determinar qué facultades de protección corresponden a cada tipo de obra y, por ende, a sus creadores, como sujetos titulares de derechos de autor. En el presente trabajo realizaremos un estudio general sobre el amparo que nuestro Ordenamiento Jurídico concede a las obras artísticas del ámbito musical como creaciones intelectuales, teniendo en consideración tanto la jurisprudencia de nuestros tribunales como las diferentes tesis doctrinales que atañen al caso. Para ello, hemos llevado a cabo una delimitación y análisis de cada una de las facultades reconocidas a los autores, y una profundización en la protección de la obra musical, desarrollando el supuesto de la copia de la obra o plagio, como uno de los ilícitos más gravosos de los derechos de autor.
