In the quantification of moral damages arising from intentional crimes, such as hate crimes based on national identity, recent jurisprudence tends to move away from applying the Traffic Compensation Scale. Instead, it focuses on criteria such as the severity of the facts, the emotional impact, and the personal circumstances of the victims. Factors such as the irreversibility of the harm, the victims' condition before and after the crime, and their testimonies during the trial are evaluated. Additionally, public humiliation and psychological suffering are considered. This flexibility allows judges to determine fair and proportional compensation based on each case.
