Abstract

El trabajo sistematiza y analiza la evolución de la jurisprudencia del TJUE sobre el artículo 18 de la Carta de Derechos Fundamentales de la Unión Europea tras diez años de vigencia. El TJUE ha tenido que dirimir un ya considerable número de conflictos sobre la aplicación del SECA. Las controversias en torno al SECA se han planteado, fundamentalmente, sobre las siguientes materias: reconocimiento y estatuto de nacionales de terceros países y apátridas como refugiados o beneficiarios de protección subsidiaria, criterios y mecanismos para determinar el Estado miembro responsable de examinar una solicitud de protección internacional y procedimiento de concesión y retirada del estatuto de refugiado en los Estados miembros. En menor medida, pero no menos importante, se ha pronunciado sobre las condiciones de acogida del solicitante de protección internacional. Asimismo, el Tribunal de Justicia ha resuelto en diversas ocasiones sobre la no adaptación en el plazo señalado, o defectos en la adaptación, del derecho de los sistemas nacionales de asilo al SECA (recordemos que uno de los graves defectos que se imputan a este Sistema es su heterogénea y deficiente transposición por parte de los Estados miembros). El trabajo también incluye el comentario y reseña de algunos extractos de la jurisprudencia del TEDH ya que esta, en muchas ocasiones, ha resultado relevante para orientar posteriores decisiones del Tribunal de Justicia de la Unión.
