Abstract

La moral tributaria, entendida como la motivación intrínseca a pagar impuestos, constituye uno de los elementos a los que las administraciones tributarias están prestando una atención creciente como mecanismo útil para fomentar un cumplimiento voluntario de las obligaciones tributarias por parte de las empresas que se encuentra estrechamente conectado con la relación cooperativa y la RSE. En nuestro estudio, tras defender la existencia de una relación directa entre esa motivación a pagar impuestos por parte de las empresas y la certidumbre fiscal, se advierte de la existencia de una tendencia a la simplificación del discurso en torno a conceptos tan complejos como los de «evasión fiscal», «elusión fiscal», «economía de opción» o «planificación fiscal» que está propiciando un nuevo estándar en el cumplimiento de las obligaciones tributarias en virtud del cual existiría una obligación ética por parte del contribuyente de pagar la mayor cantidad posible de impuestos, aun cuando la normativa tributaria aplicable establezca opciones menos onerosas que resulten igualmente admisibles desde una perspectiva estrictamente jurídica.
