Abstract

La Ley del impuesto sobre la renta de las personas físicas establece dos criterios para determinar su residencia, la permanencia personal y el centro de intereses económicos entre los que no hay prelación alguna en cuanto a su aplicación aunque existen diferencias en cuanto a la dificultad de la prueba y un criterio que sí es de aplicación subsidiaria de los dos anteriores derivado de la vinculación familiar. Por ello, la AEAT utiliza herramientas de big data para obtiene información con trascendencia tributaria pues las nuevas tecnologías y la inteligencia artificial facilitan conocer los movimientos y ubicación de los contribuyentes, algunos de los cuales intentan reconducir su tributación simulando su sujeción al impuesto sobre la renta de un ordenamiento extranjero, pero ha de hacerlo respetando los principios constitucionales y las exigencias legales.

The Personal Income Tax Act establishes two criteria to determine residence, personal permanence and the centre of economic interests, between which there is no priority in terms of their application, although there are differences in terms of the difficulty of the proof and a criterion that is applied as a subsidiary of the two previous criteria, derived from family ties. For this reason, the AEAT uses big data tools to obtain information with tax relevance, since new technologies and artificial intelligence make it easier to know the movements and location of taxpayers, some of whom try to redirect their taxation by simulating their subjection to the income tax of a foreign legal system, but must do so respecting constitutional principles and legal requirements.
