Abstract

El auge de partidos de extrema derecha en diversos países de Europa con un discurso que incita al odio racial, a la xenofobia, al antisemitismo o a cualquier otra forma de odio basada en la intolerancia, junto a la proliferación del uso de las nuevas tecnologías que facilitan la rápida difusión y dificulta la persecución de este tipo de discurso, han contribuido a generar la necesidad de hacer frente al discurso del odio mediante la intervención del Derecho penal, ignorando que la misma no debe ni puede emplearse para reprimir simples críticas, oposición o creencias, aun cuando puedan molestar o disgustar al requerirlo el pluralismo, la tolerancia y el espíritu de apertura, sin los cuales no existe sociedad democrática. En los últimos tiempos asistimos incrédulos al protagonismo que ha alcanzado el artículo 510 del Código penal en los escenarios judiciales. Un torpe legislador y una interpretación judicial favorable a restringir el derecho a la libertad de expresión -cuando se trata de tuits, comentarios en Twitter, vídeos en Facebook, pero no cuando el medio utilizado es el púlpito de una iglesia o folletos repartidos por políticos-, han hecho florecer por toda la geografía española sentencias que ponen en peligro la libertad ideológica y la libertad de expresión. Para salvaguardar estos derechos fundamentales, la presente monografía lleva a cabo una reconsideración en profundidad del artículo 510 del Código penal.
