Abstract

En los últimos años hemos asistido a un interés creciente de los Estados y las organizaciones supranacionales en las que se integran, por regular las operaciones mercantiles en las que intervienen partes que pueden ejercer influencia significativa en el contenido económico del acuerdo. En consonancia con esta tendencia, el tratamiento de las operaciones vinculadas ha ido tomando relevancia en la regulación del Impuesto sobre Sociedades español, recientemente modificado, mediante la Ley 27/2014, y de su Reglamento, aprobado por el RD 634/2015. El objetivo de este documento es poner de relieve los cambios introducidos en la normativa fiscal aplicable a las operaciones vinculadas y destacar su relación con la propuesta del Proyecto BEPS de la OCDE y el G20

In recent years we have witnessed a growing interest of States and supranational organizations that are integrated to regulate commercial transactions in which parties involved can exert significant influence on the economic substance of the agreement. In line with this trend, the treatment of related party transactions has become increasingly relevant to the regulation of Spanish corporate income tax, as recently amended by Law 27/2014, and the Regulations, approved by Royal Decree 634/2015. The purpose of this paper is to highlight the changes in the tax regulations applicable to related party transactions and highlight their relationship with the proposal of Project BEPS OECD and G20.
