Some clarifications are needed to properly understand the terms in which the ground of the judgement of the European Court of 21st December 2016 should be interpreted, especially regarding the kind of temporary limitations of the nullity of unfair terms already ordered, or to be ordered in the future, and if they are going to be addressed to our procedural system sovereignty and in which extent.
Las matizaciones a la retroactividad absoluta que se derivan de los Fundamentos de Derecho de la STJUE de 21.12.2016 hacen necesario interpretar qué tipo de limitaciones temporales a las nulidades ya declaradas, o que se puedan declarar en el futuro, quedarán encomendadas a la soberanía de nuestro sistema procesal interno.
