En el presente trabajo se realiza una sucinta descripción de la situación legal del turismo colaborativo en España que sirve como prolegómeno para describir el caso proyectado en la STSJ de Madrid (Sala de lo ContenciosoAdministrativo, Sección 8ª) núm. 292/2016 de 31 de mayo, que declara nulo el artículo 17.3 del Decreto 79/2014 de 10 de julio, el cual establece que las viviendas de uso turístico no podrán contratarse por un periodo inferior a cinco días.
The present paper exposed a brief description of the legal situation related to Spanish sharing tourism, following by an analysis in regards to the case exposed in judgment of the High Court of Justice of Madrid (Administrative Court) num. 292/2016, May 31st 2016, holding section 17.3 of Decree 79/2014 10th July, invalid. This section set out that homes for tourist use can not be contracted for a period shorter than five days.
