Varios han sido los pronunciamientos judiciales que en primera instancia declararon la existencia de error en el consentimiento de los contratantes de hipotecas multidivisas, si bien estos pronunciamientos han sido revocados en apelación. Asimismo, han sido paralizadas diversas ejecuciones hipotecarias por la eventual abusividad de la cláusula multidivisa. La reciente STJUE en la materia ha reabierto el debate existente respecto a la validez de estas hipotecas, considerando que la cláusula multidivisa no constituye elemento esencial del contrato, pudiendo ser declara nula por abusiva, además de tener que superar los requisitos de transparencia. En lo siguiente, nos proponemos realizar un análisis de dichas sentencias para finalmente ofrecer una evaluación de conjunto de la situación jurisprudencial y de las posibles estrategias a disposición de los consumidores
There have been several court rulings from first instances declaring the existence of vitiated consent in the multicurrency mortgage contracting, although these pronouncements have been reversed on appeal. Also, several rulings have crippled foreclosures because of the possible abusiveness of the multicurrency clause. The recent SCJEU on this subject has reopened the ongoing debate about the validity of these mortgages, declaring that the multicurrency clause is not an essential element of the contract, so it may be declared void for being abusive. Besides, this clause has to overcome the transparency requirements. In the following article, we are going to analyze these rulings in order to provide an overall assessment of the jurisprudential situation and the possible strategies available to consumers
