The ECJ's judgment gives an answer to the preliminary ruling query set out by Provincial Court of Castellón (Spain), regarding the impossibility of challenging the judicial decision which dismisses the debtor's opposition in the mortgage enforcement proceedings. However, the Court not only does not follow the conclusions presented by the Advocate General, but also goes much further than the query set out and criticizes the whole enforcement proceeding in Spain in its confusing resolution. This paper comments on the judgment and analyses the substance of the case
La sentencia del TJUE responde a la cuestión prejudicial relacionada con la inexistencia de la posibilidad de apelar el auto que desestima la oposición del ejecutado, planteada por la Audiencia Provincial de Castellón. No obstante, el Tribunal no sólo se aleja de las conclusiones del Abogado General, sino también va más allá de la propia cuestión planteada y critica el procedimiento ejecutivo en su totalidad en una sentencia confusa y poco cuidada.
