LA MIGRACIÓN EN EL SISTEMA INTERAMERICANO DE DERECHOS HUMANOS

Abstract

El Sistema Interamericano de Derechos Humanos, SIDH, establece unos derechos básicos reconocidos a los migrantes, sin que esto implique un derecho a la migración per se. Estos derechos se encuentran en el marco del principio de no discriminación y la obligación general de respeto de los derechos humanos reconocidos en los instrumentos internacionales. Sin embargo, no ha sido aplicado por los gobiernos nacionales. El desarrollo de sus políticas migratorias se ha dado en violación del derecho a la libertad, la nacionalidad, las garantías judiciales, el debido proceso, etc. Esta situación no parece mejorar en el futuro inmediato, razón por la cual el Sistema Interamericano de Derechos Humanos, SIDH, debe fortalecer su influencia en los estados miembros de la Organización de Estados Americanos, OEA, con el objetivo de discutir no solo el problema del reconocimiento de unos derechos básicos a los inmigrantes indocumentados, sino la pobreza frente al modelo de desarrollo neoliberal en América Latina que constituye una de las causas más frecuentes de la migración. The Inter-American Human Rights System has established a minimum of rights that should be recognized to every migrant. These rights are supported by the principle of non discrimination and the general obligation to respect every human right established in the international instruments. This does not require an assumption of the existence of a right to migration. However, those guarantees have not been yet applied by the governments. The current migration policies are in violation of the right to liberty, nationality, judicial guarantees, due process of law, etc. This situation does not seem to improve in the short-term. This is the reason why the InterAmerican Human Rights System, IHRS, should strengthen the influence on the inside of the members of the Organization of American States, OAS, with the purpose not only to discuss the recognition of the basic rights for undocumented immigrants, but poverty related to by the neoliberal development model in Latin America, which constitutes the most frequent cause of migration.
