Abstract

La obra aborda el estudio de una de las cuestiones capitales del Derecho de autor como es el concepto legal de obra. En ella, se enumeran y analizan los requisitos legal y jurisprudencialmente exigidos a las creaciones intelectuales para acceder a la protección. Tras dicho análisis, se estudian en detalle las reglas de atribución de la titularidad de este derecho subjetivo contenidas en el Texto Refundido de la Ley de Propiedad intelectual, en especial, cuando la obra es fruto de la colaboración artística o literaria de varios autores. El surgimiento de nuevos conceptos creativos como son el software, las bases de datos y las obras multimedia exige una obra de estas características.

The work deals with the study of one of the capital issues of copyright law, the legal concept of work. It lists and analyses the legal and jurisprudential requirements demanded of intellectual creations in order to be eligible for protection. After this analysis, the rules of attribution of the ownership of this subjective right contained in the Revised Text of the Intellectual Property Law are studied in detail, especially when the work is the result of the artistic or literary collaboration of several authors. The emergence of new creative concepts such as software, databases and multimedia works requires a study of these characteristics.
