Abstract

En el ámbito de las causas para la declaración de nulidad de pleno derecho de los actos administrativos, que ya de por sí tienen una aplicación restrictiva, reviste especial complejidad la correspondiente a la nulidad radical provocada por la doble imposición de una sanción por el mismo hecho infractor: una en sede administrativa como consecuencia del trámite sancionador, y, la otra, como pena establecida en Sentencia firme en la jurisdicción penal. Tal complejidad tiene su materialización en la existencia de una primera sanción administrativa, inicialmente conforme a derecho que, por el posterior pronunciamiento condenatorio de la jurisdicción penal sobre los mismos hechos, deviene en nula por vulnerar el principio de non bis in idem, proclamado en el art. 25 CE como parte del contenido del derecho fundamental a la legalidad penal. In the area of the causes for the declaration of nullity of administrative acts, which already have a restrictive application, particularly complex corresponding to the nullity caused by the double imposition of a sanction for the same offense offender: one on administrative headquarters as a result of disciplinary proceedings, and the other, as a penalty established by a final judgment in the criminal courts. Such complexity has its realization in the existence of a first administrative penalty, initially lawful, on the back damning pronouncement of criminal jurisdiction on the same facts, it becomes void for violating the principle of non bis in idem, enshrined in art. 25 EC as part of the fundamental right to legality.
