La posibilidad de encuadrar al indulto como acto administrativo o acto político, como acto discrecional o acto graciable, lleva consigo una construcción teórico jurídica sobre la determinación de la naturaleza jurídica de cada una de las tipologías citadas, para poder establecer los elementos que configuran a cada una de ellas y, desde éstos, llegar a afirmar o excluir su identidad con los elementos que configuran el acto de otorgamiento del indulto.
