Abstract

El proceso penal y el Derecho penal han experimentado una metamorfosis en la era de la globalización y la digitalización. Nuevos instrumentos, nuevos protagonistas y nueva manera de conformar el modelo de justicia en el siglo XXI. La eficiencia y la celeridad han inspirado reformas procesales que buscan abreviaciones del proceso, mediante reforma de instituciones procesales (medidas cautelares, reducción de recursos ), así como procedimientos rápidos o abreviados, en los que se potencian los acuerdos, los pactos, tanto en el proceso -plea bargaining- como en los realizados entre víctima y victimario (mediación). Igualmente, la tecnología ha penetrado en la investigación y sus protagonistas son el Ministerio Público y la policía. El dilema es siempre el equilibrio entre garantías y eficiencia, entre las personas y la sociedad. The criminal process and Criminal Law have undergone a metamorphosis in the era of globalization and digitization. New instruments, new protagonists and a new way of shaping the model of Justice in the XXI Century. Efficiency and Speed have inspired procedural reforms that seek abbreviations of the process, through reform of procedural institutions (coercitive and praeventive measures, reduction of resources ...) as well as rapid or abbreviated procedures in which agreements and pacts are promoted, both in the process -plea bargaining- such as those carried out between the victim and the perpetrator (mediation). Likewise, technology has penetrated the investigation and its protagonists are the Public Ministry and the Police. The dilemma is always the balance between guarantees and efficiency, between people and society.
