Los últimos años han visto un crecimiento exponencial del recurso al arbitraje comercial internacional. Sin embargo, los problemas que acompañan a la institución en tiempos recientes están haciendo que ésta entre en una era de desencanto que, entre otros efectos, da lugar al fomento de otros instrumentos MASC como pueda ser la mediación. La CNUDMI es consciente de ello y está en estos momentos trabajando en un nuevo instrumento sobre arbitraje acelerado. El presente artículo aborda la situación de estos trabajos a la vez que valora el tenue equilibrio existente entre el fomento a ultranza de la rapidez del arbitraje -el mantra de la celeridad- con la necesidad de salvaguardar unas garantías procesales mínimas. The use of international commercial arbitration has increased steadily during the last decades. However, in recent times the institution has shown some weaknesses and criticisms are increasing. It seems that we are entering a new 'era of disenchantment' that, among other effects, favours the the promotion of other ADR devices, like mediation. UNCITRAL is fully aware of this and it is currently working on a new instrument on expedited arbitration. The present article addresses the situation of these works while evaluating the tenuous balance existing between fostering the speed of arbitration - the mantra of speed - and the need to safeguard some minimum procedural guarantees.
