Abstract

The use of international commercial arbitration has increased steadily during the last decades. However, in recent times the institution has shown some weaknesses and criticisms are increasing. It seems that we are entering a new 'era of disenchantment' that, among other effects, favours the the promotion of other ADR devices, like mediation. UNCITRAL is fully aware of this and it is currently working on a new instrument on expedited arbitration. The present article addresses the situation of these works while evaluating the tenuous balance existing between fostering the speed of arbitration - the mantra of speed - and the need to safeguard some minimum procedural guarantees.
