El trabajo penitenciario como derecho y como deber

Abstract

En la normativa penitenciaria española el trabajo tiene la consideración de derecho y deber para las personas que se encuentran cumpliendo condena y se plantea la duda de si esta calificación es simplemente una reproducción de lo previsto en el artículo 35.1 de la Constitución o si se debe realizar una interpretación diferente, ya que en realidad no es ésta la única opción posible. ¿Podría tratarse de un derecho subjetivo auténtico exigible frente al Estado y de un deber jurídico para los presos? Para resolver esta interrogante conviene analizar la normativa penitenciaria en su conjunto y también tener en cuenta lo dispuesto en el artículo 25.2 de la Constitución. Se comprobará, igualmente, que Estados Unidos sí obliga a los presos a trabajar, y se sabrá por qué se hace. In Spanish prison regulations work is considered a right and a duty to the people sentenced to imprisonment and it is unclear whether this is simply a reproduction of the provisions of Article 35 of the constitution or if it is possible to make a different interpretation, since this is not the only option. Could it be a real subjective right enforceable against the State and a legal duty to the prisoners? To address this question we must analyze the overall prison regulations and take into account the provisions of Article 25.2 of the Constitution. As will be seen, the USA forces work to prisoners, and we shall know why.
