Acuerdos no poach y derecho de la competencia

Abstract

El presente artículo parte de la delimitación previa del mercado de trabajo para analizar los acuerdos horizontales que se producen entre demandantes de empleo ¿ los empresarios¿ consistentes en no captar (en diferentes extensiones) a los trabajadores que presentan sus servicios para la competencia. Este cártel de reparto de mercados ha de ser considerado anticompetitivo cuando no sirve un fin superior porque dañan la estructura del mercado laboral generando artificialmente a través de pactos de no captación los mismos efectos que tendrían verdaderos monopsonios, perjudican la estructura de mercados de producto y servicios aguas-abajo, y, de forma más evidente, dañan a los trabajadores. No obstante, en algunos casos, se trata de un acuerdo accesorio a otro por el que se crea una red de franquicia o distribución, o cuando se produce una colaboración entre empresarios a través de una joint venture o se escinde una sociedad . En estos supuestos, el acuerdo habrá de someterse al examen de la restricción accesoria
