La prueba del consentimiento afirmativo en violencia sexual

Abstract

La incorporación del consentimiento afirmativo tras la Ley Orgánica 10/2022, de 6 de septiembre, de garantía integral de la libertad sexual invita a realizar una aproximación a los problemas probatorios que emergen en sede judicial. La problemática en términos jurídicos arrastra una discusión política no resuelta relativa a la propia definición e interpretación del hecho de consentir de difícil solución por parte de los tribunales. En el ámbito estrictamente probatorio surgen dos cuestiones críticas. Por un lado, la permeación de estereotipos con base en modelos ideales de buena víctima y, por otro, las propuestas tentativas relativas a revisar la carga de la prueba. La centralidad otorgada al consentimiento en la norma no viene acompañada de una reforma procesal-constitucional equivalente por lo que a cada uno de estos puntos controvertidos se ofrecen alternativas acordes a la normativa vigente que se basan, respectivamente, en la implementación de la perspectiva de género interseccional y en la aplicación efectiva de medidas procesales de protección, con el fin de reforzar las garantías del proceso penal y evitar la reproducción de desigualdades en la administración de justicia.
