La interpretación de los testamentos siempre ha sido cuestión controvertida. El planteamiento del Código Civil solo ofrece unos elementos mínimos para llevarla a cabo. Se hace necesario identificar criterios que permitan saber cuándo cierta interpretación va a ser considerada admisible y quiénes están legitimados para interpretar el testamento. En la práctica, esas dificultades imponen un difícil equilibrio entre la posición de los diversos interesados y en la tensión entre seguridad jurídica y facilitación del tráfico. The interpretation of wills has always been a controversial issue. The approach of the Spanish Civil Code offers only minimal elements to carry it out. It is necessary to identify criteria that allow to know when a certain interpretation will be considered admissible and who is entitled to interpret the will. In practice, these difficulties impose a difficult balance between the position of the various stakeholders and in the tension between legal certainty and facilitation of traffic.
